MASS. ETHICS COMMISSION: Cape & Islands District Attorney Robert Galibois Pays $5,000 Penalty for Violating Conflict of Interest Law

[State Ethics Commission media statement]  ?  Cape and Islands District Attorney Robert J. Galibois II has paid a $5,000 civil penalty for violating the conflict of interest law by using public resources to attempt to cast himself in a favorable public light after he was involved in a motor vehicle accident and to promote a campaign donor's rental apartments to office staff. Galibois signed a Disposition Agreement in which he admitted the violations and waived his right to a hearing. On February 23, 2023, Galibois was involved in an accident while making an illegal U-turn in his state vehicle. The Barnstable Police Department issued him a warning for making an improper turn, a marked lanes violation, and failure to file an accident report. In response to the news media attention drawn by the accident, Galibois directed his Second Assistant DA to draft a press release. The press release, issued on DA's Office letterhead, was designed to turn the public narrative of the accident in Galibois' favor. Also in February 2023, shortly after Galibois was sworn into office, a donor to his campaign texted him that he wanted to offer some of his rental apartments to DA's Office staff before publicly advertising them. Galibois then sent an office-wide email informing his staff of the available apartments and offering to provide the donor's contact information to anyone interested. Galibois subsequently referred two of his Assistant DAs to the donor. The conflict of interest law prohibits public employees from using or attempting to use their official positions to secure valuable unwarranted benefits for themselves or others. Galibois violated this prohibition by using his position as District Attorney and the resources of his public office to publicize a version of his motor vehicle accident favorable to himself for his own personal advantage. Galibois also violated this prohibition by using the resources of his public office to promote his campaign donor's apartments to a targeted group of desirable prospective tenants, his DA's Office staff. ?A core principle of the conflict of interest law is that public resources, such as public agency media releases, email, and staff worktime, must not be used to further private interests. District Attorney Galibois failed to uphold this principle when he used the resources of his office to further his own private interests and those of a donor to his election campaign,? said State Ethics Commission Executive Director David A. Wilson. ?Public resources are to be used for the public's benefit.?   BARNSTABLE, MASSACHUSETTS ? [VIDEO NOTES] ? A Hyannis News reader was sideswiped by a box truck yesterday morning, near the intersection of Route 132 and Bearses Way. She immediately called 911 and tried to follow the out-of-control box truck as it apparently took off toward the highway. (The following is cellphone video sent in by the woman who was struck.) Moments later, the box truck left the roadway and went head-on with a metal traffic light pole on Route 132 at the on-ramp to Route 6 westbound, across from the Burger King rest area. The box truck had apparently sideswiped several vehicles prior to slamming into the metal pole. The box truck was heavily damaged, and the driver remained behind the wheel, apparently dazed and confused. Some of the video (which will remain unpublished), shows the driver staring at witnesses who pulled over to check on him. Suddenly, the driver began to suffer some type of intense seizure as medically trained civilians entered the truck's cab to provide first aid until first responders could arrive. The driver was assisted onto the ground, where he was surrounded by first responders rendering first aid. While being treated, he became ?slightly combative,? according to radio transmissions. The 32-year-old male from Brocton was transported to Cape Cod Hospital under a trauma alert. The patient was still ?combative? at the time of being transported. Police followed the ambulance to CCH. The patient's current condition was unknown at the time of this report. Four others ? occupants of vehicles that had been struck ? were evaluated on scene but not transported. The 6-wheel commercial box truck was heavily damaged. The crash took down traffic signals at the busy intersection and crews were immediately notified regarding the need for repairs. Early morning airport snaps? (through an unfriendly chain link fence? so, that's all you're gettin')     Following HN photos: Patient found naked and covered with blood inside the lobby to a Hyannis apartment building Sunday morning. Police were first called about the naked man walking around outside of the building. Cape Cod Hospital was placed on a priority two trauma alert for facial injuries, including a swollen eye. The man, in his mid-20s, was unable to communicate verbally? so there was no explanation as to what actually had happened to him. Barnstable Police were looking into the situation. Barnstable Police and Hyannis Rescue responded to a Hyannis hotel for a man and woman high on psychedelics with a one-year-old baby in the room. Both were visiting from out of state.
